Terms governing access to NICOLE GOLF LAB PRO, memberships, trainers, community and AI analysis

IMPORTANT: This document is a detailed operational draft prepared from the current application features. Before publication, the operator must insert the legal entity, address, contact details, designated privacy contact, retention periods, and the exact names of all external processors. Obtain a qualified legal review for the jurisdictions in which the service is offered.

1. Operator and Agreement

These Terms of Use (“Terms”) govern your access to and use of NICOLE GOLF LAB PRO and related websites and services. By creating an account, accessing the Service, or purchasing a membership, you agree to these Terms.

If you do not agree, do not use the Service. Additional product, privacy, community or payment notices may apply and form part of these Terms when clearly presented.

2. Eligibility and Accounts

• You must meet the minimum legal age applicable in your country and be able to enter a binding agreement.
• You must provide accurate information and keep it current.
• You are responsible for your password, access tokens and activity under your account.
• One person may not create accounts to evade limits, bans or moderation.
• You must notify the operator promptly if you suspect unauthorised access.
• The operator may require verification before approving professional trainer profiles or handling sensitive account requests.

3. Service Description

The Service provides golf video archiving, classic video analysis, AI-assisted swing analysis, swing metrics, frame stepping, slow motion, drawing and annotation tools, zoom, comparison of videos, trainer discovery, private messaging, community features, ratings, support and paid membership features. Features may vary by account type, language, device, operating system, subscription status and availability of external services.

4. AI and Sports-Analysis Disclaimer

AI and video analysis are informational sports-performance tools. They are not a medical diagnosis, physiotherapy assessment, safety certification, guarantee of performance, or substitute for an in-person qualified golf professional. Metrics, posture scores, swing phases, tempo ratios, recommendations and drill suggestions may be incomplete or inaccurate. You use them at your own risk and should stop any activity that causes pain or injury and seek appropriate professional advice.

5. User Content and Permissions

You retain ownership of content you upload or submit. You grant the operator a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, technically process, display to the audience you select and otherwise use that content only as necessary to operate, secure, moderate and improve the Service, comply with law and resolve disputes. This licence ends when the content is deleted, subject to backups, legal retention and records needed for safety or disputes.

You represent that you have all rights, permissions and consents required for every photograph, video, voice recording, name, likeness and other content you submit. Do not upload another person’s image or video without permission. Do not upload payment-card data, government IDs, medical records or unrelated sensitive information.

6. Prohibited Content and Conduct

• Illegal, fraudulent, threatening, defamatory, hateful, harassing or abusive content;
• Sexual exploitation, non-consensual intimate imagery or content involving minors;
• Spam, bulk messaging, scams, impersonation or attempts to obtain passwords or payment details;
• Malware, scraping, reverse engineering, unauthorised access or interference with the Service;
• Publishing another person’s private information without a lawful basis or consent;
• Manipulating ratings, creating duplicate accounts or evading usage limits or enforcement;
• Using AI outputs as a guarantee, medical recommendation or dangerous instruction.

7. Classic and AI Video Analysis

Uploads may be subject to weekly limits, file-size or format requirements, account limits and temporary availability constraints. The Service may reject or partially process videos that are corrupt, too short, poorly lit, unsuitable for pose estimation, unsupported, or unsafe to process. You are responsible for maintaining your own copy of important videos.

8. Trainer Profiles and Professional Accounts

Professional trainers may submit education, city, country, continent, biography, specialisation, languages, experience and availability. Publication is subject to administrative approval and may be suspended or rejected. Trainers must provide truthful information and remain responsible for advice they give. A public profile may show only the fields selected for public display.

The operator does not guarantee a trainer’s qualifications, availability, response time, results or suitability. Users must independently verify a trainer before relying on advice or arranging any separate service.

9. Private Messaging

Amateurs may initiate conversations with professionals. Professionals may reply after an amateur starts a conversation, subject to account status and safety controls. Messages are intended for the participants but are not an end-to-end encrypted service. The operator may process messages when needed for reports, moderation, spam prevention, account security, legal compliance or dispute resolution. Do not send passwords, payment-card numbers, government IDs or sensitive information.

10. Community and Ratings

Community posts, replies, ratings and comments must be relevant, truthful and respectful. Ratings may be subject to duplicate-rating protection, moderation, reports, approval, hiding, deletion, trainer replies and appeals. Only approved ratings count toward public averages. The operator may preserve moderation records and may respond to the person who submitted a report.

11. Moderation, Suspension and Appeals

The operator may warn, limit, hide, remove, suspend or terminate content or accounts where it reasonably believes the Terms, law, safety requirements or platform rules have been breached. Actions may also be taken to prevent spam, fraud, harassment or security abuse. Users may submit an appeal through available in-app tools or support channels. An appeal does not automatically restore access or content.

12. Memberships and Premium Access

The Service offers account tiers and paid memberships. Guest, registered free, amateur Premium and professional memberships may have different limits and features. Current prices, periods, currencies and included features are displayed at checkout. The professional plan is intended for approved professional trainers and may be available only to that profile type.

Membership activation depends on successful payment confirmation and receipt of the relevant order information. A subsequent eligible purchase may extend an active membership according to the product rules. Refunds, cancellations, taxes and consumer rights are governed by applicable law and the payment checkout terms. Membership access may be affected by a refund, chargeback, fraud review, account suspension or platform limitation.

13. External Checkout, WooCommerce and Stripe

Current application code directs membership purchases to nicolesport.com, where WooCommerce and Stripe may process payment. Card details should be entered only in the secure checkout provided by the payment provider. The operator does not intend to receive or store full card numbers. Orders, product identifiers, amount, currency, payment status and entitlement information may be transmitted to the operator for membership management.

Before publishing on Google Play, the operator must confirm that the external checkout complies with the applicable Google Play payments policy. If Google Play Billing is required for the paid digital features, the purchase flow must be migrated or adapted before production release. A web checkout alone is not a guarantee of Play compliance.

14. Intellectual Property

The Service, software, design, branding, logos, text, non-user content and underlying technology are owned by or licensed to the operator. Except for the limited right to use the Service under these Terms, no rights are transferred. You may not copy, sell, sublicense, decompile, distribute or commercially exploit the Service without written permission.

15. Privacy and Data Deletion

The Privacy Policy explains how personal data is processed. You may request deletion through the in-app account tools and the public account-deletion page: [insert public deletion URL]. Deletion may remove account data, profile data, photos, videos, messages and analysis history, subject to lawful retention, security records, backups, tax/accounting obligations and the rights of other users.

16. Availability and Third-Party Services

The Service may depend on internet connectivity, hosting, AI, payment, notification, email, WordPress, WooCommerce, Stripe and other third-party services. The operator does not guarantee uninterrupted availability, processing speed, AI availability, successful delivery of notifications or compatibility with every device. The operator may perform maintenance, change features or discontinue a feature with reasonable notice where practicable.

17. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. The operator does not warrant that analysis results will be complete, accurate, uninterrupted or suitable for a particular purpose. Nothing in these Terms limits mandatory consumer rights, liability that cannot lawfully be excluded, or liability for intentional misconduct.

18. Limitation of Liability

To the maximum extent permitted by law, the operator is not liable for indirect, incidental, special, consequential or loss-of-profit damages arising from use of the Service, loss of content, reliance on AI outputs, trainer interactions, community content, payment-provider failures or unauthorised access not caused by the operator’s breach. Where liability cannot be excluded, it is limited to the amount paid by the user for the relevant Service during the applicable period, subject to mandatory law.

19. Indemnity

You agree to defend and hold the operator harmless from claims, losses and costs arising from your unlawful use of the Service, breach of these Terms, infringement of another person’s rights, or content you submit, except to the extent caused by the operator’s own unlawful conduct.

20. Changes and Termination

We may update these Terms when the Service, law or payment model changes. Material changes will be communicated through the Service or website where practicable. You may stop using the Service and request account deletion. The operator may suspend or terminate access for breach, risk, non-payment, legal reasons, security or prolonged inactivity. Provisions concerning ownership, privacy, payment obligations, disputes and retained records survive termination where necessary.
